I’ve already started my application. Will the approved changes affect my case?
For those who have already submitted a Portuguese nationality application, the general rule in Portugal is straightforward: each case is reviewed based on the law in force at the time of submission. In other words, if your application has already been filed and is awaiting review, it remains in the queue without being affected by this new amendment.
On the other hand, the impact is more direct for those who have not yet started certain applications, especially within the family context. This is where the changes become more relevant in practice.
Those who may be affected include adult family members who have not yet applied through the Sephardic route (such as uncles, cousins, siblings, among others), minor children whose nationality has not yet been requested, and spouses who have not yet started their application.
It is also important to distinguish between two aspects: the law itself and the processing timeline. Even without changes in legislation, processing times continue to depend on each registry office and the overall volume of applications.
Frequently asked questions:
Can my application be canceled because of the new law?
No. Each application is reviewed according to the rules in place at the time of analysis. Applications submitted before September 2022 are not subject to proof of ties, while those submitted after that date are.
Will the Sephardic route no longer apply to those who have already submitted?
No. The change only affects those who have not yet applied through the Sephardic route, which may no longer be available if and when the proposal is approved by the President.
Can I include family members later?
It depends. The new proposal introduces criteria for extending nationality to minor children and spouses, such as proof of knowledge of Portuguese culture. However, these requirements will only apply once the regulation is formally updated.
The current scenario combines continuity for those who have already applied with significant changes for those who are still planning to start related applications. The best course of action is to act now to avoid potential limitations when extending nationality to family members.
According to the most recent update, the current review dates at the registry offices are as follows:
