THE Organic Law No. 2/2020, of November 10, amended the wording of al) f), paragraph 1, of article 1 of the Nationality Law, reinforcing the principle of ius alone. Thus, it started to consider that individuals born in Portuguese territory, children of foreigners, have access to the original Portuguese nationality.
The legal provision automatically apply to those born after November 11, 2020. Those who were born before November 11, 2020, provided that at the date of birth they met these requirements, can now apply to a Conservatory, under the terms of article 70, no. 6 of the Nationality Regulation.
In this sense, foreigners who are parents of an original Portuguese child can also acquire Portuguese nationality by naturalization under the terms of article 6, paragraph 8 of the Nationality Law.
